1. Acceptance of Terms

By accessing or using Cyber Incident ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Cyber Incident provides security awareness tools including data breach checking, password exposure checking, IP reputation checking, and domain threat analysis. The Service is provided for informational purposes only.

3. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, completeness, or reliability of any information
• Fitness for a particular purpose
• Non-infringement
• Security or error-free operation

CYBER INCIDENT, VIJILAN, AND ALL AFFILIATED PARTNERS INCLUDING BUT NOT LIMITED TO CROWDSTRIKE, CRIBL, HAVE I BEEN PWNED, ABUSEIPDB, ALIENVAULT, GREYNOISE, URLHAUS, DEHASHED, AND ANY OTHER DATA PROVIDERS OR TECHNOLOGY PARTNERS ("AFFILIATED PARTIES") MAKE NO GUARANTEES REGARDING THE ACCURACY OR COMPLETENESS OF BREACH DATA, PASSWORD EXPOSURE DATA, OR ANY OTHER SECURITY INFORMATION PROVIDED.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CYBER INCIDENT, VIJILAN, AND ALL AFFILIATED PARTIES SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business, or goodwill
• Personal injury or property damage
• Security breaches or data loss
• Errors, omissions, or inaccuracies in the data provided
• Actions taken or not taken based on information provided by the Service
• Third-party actions, products, or services

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

5. Indemnification

You agree to indemnify, defend, and hold harmless Cyber Incident, Vijilan, and all Affiliated Parties, including their officers, directors, employees, agents, and successors, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the Service

6. Data Sources and Third-Party Services

The Service aggregates data from multiple third-party sources. We do not control, verify, or guarantee the accuracy of third-party data. You acknowledge that:

• Breach data may be incomplete or outdated
• Password exposure data reflects known breaches only
• Absence of results does not guarantee safety
• You should not rely solely on this Service for security decisions

7. No Professional Advice

The Service does not provide legal, financial, cybersecurity consulting, or professional advice. Information provided is for general awareness only. For specific security concerns, consult qualified professionals.

8. Paid Services and Subscriptions

For paid protection services:

• Prices are subject to change with notice
• Subscriptions auto-renew unless cancelled
• Refunds are provided per our refund policy
• Third-party protection services (CrowdStrike, etc.) are subject to their own terms

9. Termination

We reserve the right to suspend or terminate your access at any time, for any reason, without notice or liability.

10. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

11. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class actions.

12. Severability

If any provision is found unenforceable, the remaining provisions shall continue in effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Cyber Incident regarding the Service.
